Upon any violation of 310 Web Hosting Acceptable Use Policy, your Internet web services may be terminated without further warning and any all payment amounts due or any other administrative charges necessary to enforce or recover from your damages become due and payable immediately.

310 Web Hosting Acceptable Use Policy is designed to help protect our customers and the Internet community from irresponsible or illegal activities. As such, we prohibit unsolicited commercial appeals and/or any disruption of Internet services. Examples of such activities are given below:

Sending unsolicited e-mail is strictly prohibited. Using an any e-mail address hosted by 310 Web Hosting to collect responses from unsolicited commercial e-mail is also prohibited. Having a web address referenced as a marketing beneficiary to an unsolicited email, "Spam-by-Reference", is prohibited. Due to the administrative cost associated with researching and enforcing violations of this policy, 310 Web Hosting reserves the right to make an administrative charge of up to $500 for each occurrence against any violators of this policy.

310 Web Hosting does not design, develop, host or promote any sites which contain any material which is illegal or which could be construed as illegal.

Material which might be construed as "unethical" can be terminated and discontinued upon the receipt of a satisfactory amount of complaints and the website owner and customer will indemnify 310 Web Hosting and hold us "harmless" for any legal suits brought against them for civil violations or other violations of law.

Activities which adversely affect the ability of other people or systems to use our services are prohibited.

Attempts, whether successful or not, to gain access to any computer system, server, or customer's data, without consent is prohibited and also illegal. These actions will not be tolerated and will be reported to the proper authorities including the FBI.

It may be necessary for 310 Web Hosting employees to examine system accounting logs, website content, and other records to resolve system problems. 310 Web Hosting reserves the right to access an account's mailbox to resolve system problems or mail system errors.

310 Web Hosting hosting accounts have limits on the storage space allowed for both the website and e-mail together. To minimize the chances of this occurring, customers should make sure their e-mail program settings are not causing e-mail to be left on the server. Any email left on the server for more than 30 days, is subject to being erased immediately. If the total storage exceeds the hosting plan limits, they will be subject to additional charges for that billing period (monthly or quarterly). If 310 Web Hosting determines that an account is exceeding the disk utilization limit but the email is not older than 30 days, the account owner will be notified by e-mail and sent an updated invoice. If the excess use continues for more than 24 hours after such notification, the owner will be given the choice of upgrading to a larger account or to modifying the activity creating the excess use or the email or website content will be erased to bring the customer within compliance.

If an account uses an excessive amount of bandwidth, the account owner will be notified by e-mail (to the email address on record within our accounting system) as soon as practicable. The customer will be responsible for excess charges for that month or quarter of service.

Attempting to impersonate any person, using forged headers or other identifying information, is prohibited. The use of nicknames does not constitute impersonation.

In the event that an account is inactivated or suspended as a result of any prohibited activities, the account may be subject to reactivation charges and/or deposit requirements to be determined by 310 Web Hosting. Untimely payment of any and all amounts due may result in account suspension and/or cancellation.

If you violate one or more of these acceptable use policies, we reserve the right to terminate service without notice. In addition, 310 Web Hosting will cooperate with the appropriate legal authorities in investigating claims of illegal activity, including but not limited to illegal transfer or use of copyrighted material, postings or e-mail containing threats of violence, or other illegal activity.

If you believe one of the 310 Web Hosting clients have violated this policy, you are invited to report the violation at abuse@310inc.com. We will look into the matter and take appropriate action.
  

ACCEPTABLE USE POLICY

PLEASE READ CAREFULLY BEFORE USING OUR SERVICES.

THIS ACCEPTABLE USE POLICY CONSTITUTES A LEGAL AGREEMENT BETWEEN YOU AND 310 Web Hosting , a provider of retail web hosting, e-mail, electronic commerce, and domain name services (“Services”).

A. ACCEPTANCE:

1. YOU AGREE TO REFRAIN FROM THE FOLLOWING EXAMPLES OF PROHIBITED CONDUCT;

2. IF YOU ARE ACCEPTING ON BEHALF OF A COMPANY, YOU REPRESENT AND WARRANT TO 310 Web Hosting  THAT YOU HAVE FULL AUTHORITY TO BIND SUCH COMPANY; AND

3. IF YOU DO NOT AGREE TO ABIDE BY THIS POLICY PLEASE DO NOT USE OUR SERVICES.

B. PROHIBITED CONDUCT

You will violate this Policy if you engage in the following examples of prohibited activities while using our Services: 

(a)      Spamming

(i)       Sending unsolicited bulk and/or commercial messages over the Internet (known as “spamming”)

(ii)     Maintaining an open SMTP relay

(b)     Facilitating a Violation of this Policy

(i)         Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this Policy, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks, and piracy of software

(c)      Infringing Intellectual Property Rights

(i)                   Engaging in any activity that:

A          infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, s, or other entities

B           violates privacy, publicity, or other personal rights of others

(d)     Obscene Speech or Materials

(i)         Using 310 Web Hosting's Services to advertise, transmit, store, post, display, or otherwise make available child pornography or other forms of pornography or obscene speech or material. 310 Web Hosting  shall notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through 310 Web Hosting ’s Services

(e)      Promoting Violence or Injury

(i)         Advocating, promoting or providing assistance in carrying out violence or any other unlawful activity against any persons, animals or any governments, businesses or other entities

(ii)        Describing or displaying a weapon, or parts of weapons, or manuals for assembling any weapon, including but not limited to firearms, ammunition, explosives, grenades, bombs and caustic or other dangerous substances

(i)        Promoting products or services that involve a significant risk of death or injury to any persons, or damage to business or other entities or property

(f)      Defamatory or Abusive Language

(i)         Using 310 Web Hosting ’s Services as a means to transmit or post defamatory, harassing, abusive, or threatening language

(g)      Forging of Headers

(i)         Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message

(h)     Illegal or Unauthorized Access to Other Computers or Networks

(i)         Accessing illegally or without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking")

(ii)        Engaging in any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity)

(i)       Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities

(i)         Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mailbombing, or denial of service attacks

(ii)        Engaging in activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment

(j)       Export Control Violations

(i)         Exporting encryption software over the Internet or otherwise, to points outside Canada or the United States

(k)     Illegal Activities

(i)         Engaging in activities that are determined to be illegal, including advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, and pirating software

(l)       Gambling

(i)          Engaging in or promoting gambling

(m)    Promoting Intoxicants

(i)         Displaying or promoting any type(s) of intoxicant, alcoholic beverage, cigarettes or illegal substance

(n)     Instructing others in Prohibited Activities

(i)       Providing instructions with respect to any activities listed in (a) through (n) above

(o)     Other Activities

(i)         Engaging in any other activity, whether lawful or unlawful, that 310 Web Hosting  in its sole discretion determines to be harmful to customers, operations, reputation, goodwill, or customer relations.

 

All Hosting clients using 310 Web Hosting Services agree to the following policies:
